General

This Privacy Policy covers Glastender’s treatment of personally identifiable information that Glastender may gather when you are accessing or using the Services. Glastender may gather various types of personal information from its users, as explained in more detail below, and Glastender may use this personal information internally in connection with the Services, including to personalize, provide, and improve its Services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some personal information with third parties, but only as described below.

Personal Information Collection

a. Information you provide. Glastender may store any information you knowingly provide to it. Certain information may be required to take advantage of some of our features. For example, if you chose to send us your Design, we will collect your name and email address. Glastender may communicate with you if you’ve provided it the means to do so. For example, if you provided Glastender your email address, Glastender may send you promotional emails about Glastender, or email you about your use of the Services. If you do not want to receive communications from Glastender, please indicate your preference by clicking the unsubscribe link in the applicable email or notifying Glastender at info@glastender.com.

b. Automatically collected device information. Whenever you interact with the Services, Glastender may automatically receive and collect certain information on Glastender’s server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access the Services, and the page or feature you requested.

Personal Information Disclosure to Third Parties

Glastender will NOT sell, rent or give a visitor’s personally identifying information to a third party, subject to the following exceptions: in connection with a substantial corporate transaction, such as a sale or merger of Glastender and/or the sale of the Services; or to third-party vendors or service providers that Glastender works with to help carry out the Services and other functions related to the Services (for example customer service, email deployment, business analytics, marketing, advertising, performance monitoring, hosting, and data processing).

Third parties may collect information about you when you interact with the Services. When you voluntarily provide personal information to Glastender, you grant Glastender permission to share this information with such third parties for the purpose of carrying out the Services. The third parties’ use of personal information is subject to their own privacy policies. These are independent software and/or service providers and Glastender does not assume any liability about the information collection policies of these providers, or about any kind of issue, legal or otherwise, relating to them. If you do not want your personal information shared with these third parties, you should not use the Services.

Your personal identifying information may be disclosed if Glastender is compelled by law or legal process to disclose it. Glastender will cooperate with law enforcement inquiries, obey court orders, and honor subpoenas and other legal process. Glastender may also disclose such information if Glastender determines, in its sole discretion, that disclosure would be useful in connection with investigating possible non-compliance either with the law or any Glastender policy, including its Terms of Use, or in cases of injury to or interference with (whether intentionally or unintentionally) Glastender’s rights or property or those of anyone else who may be harmed by such actions, such as our users or visitors.

Glastender may use an analytical tool to collect aggregated data (information that is no longer linked to your personally identifiable information) about the users of the Services. Glastender may also share this aggregate information with our advertisers, business partners, sponsors and certain others. As mentioned above, this aggregate information is used to develop, improve and customize the Services to better serve visitors to the Website.

Cookies

Cookies are small pieces of information or files that a website puts on a computer’s hard disk for record-keeping purposes. The Services use cookies to help you personalize your online experience. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. Glastender’s advertising partners may transmit cookies to your browser or device, when you click on ads that appear on the Services. If you click on a link to a third-party website or service, such third party may transmit cookies to you. THIS PRIVACY POLICY DOES NOT COVER THE USE OF COOKIES BY ANY THIRD PARTIES, AND GLASTENDER IS NOT RESPONSIBLE FOR THOSE THIRD PARTIES’ PRIVACY POLICIES AND PRACTICES.

Requests for Feedback

Glastender may request feedback from visitors regarding an activity or piece of content associated with the Services. Feedback is used for internal purposes only, and any personally identifiable information that is accidentally submitted is not used for any purpose.

Third-Party Providers

Certain features of the Services may use the services and/or products of third-party vendors/service providers third-party and business partners, which services and/or products may include software, information, data collection or other services. When using features from third-party service providers, you understand that you may be subject to additional terms of use/service and privacy policy(ies) of the third-party service provider. As a result of your use of the Services, additional fees and charges from your third-party service providers may apply.

If you access the Services through a mobile application or other type of third-party platform, the applicable end user license agreement for the service through which you downloaded the application may apply in addition to the terms of these Terms of Use and you agree that you are subject to such application or platforms terms in addition to these Terms of Use.

Personal Information of Minors Under 13

Transfer of Personal Information Across Borders

If you interact with Glastender or provide your personal information to Glastender, your personal information may be transferred to, processed and maintained on servers or databases in the U.S. The U.S. may have data protection laws that are less protective than the laws of the country in which you reside. By using the Services or providing Glastender with any information, you consent to the transfer to, and processing, usage, sharing and storage of your information in the U.S., in accordance with this Privacy Policy. If you do not want your personal information transferred to or processed or maintained outside of the country or jurisdiction where you are located, you should not use the Services.

Do Not Track

Your browser may offer you a “Do Not Track” option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. At this time, the Services do not respond to Do Not Track beacons sent by browser plugins, which means Glastender may collect information about your online activity both while you are using the Services and after you leave the Services.

REMEMBER THAT THIS IS GLASTENDER’S DO NOT TRACK POLICY. GLASTENDER CANNOT AND DOES NOT MAKE ANY REPRESENTATIONS ABOUT HOW THIRD PARTIES REACT WHEN YOU SET THIS SIGNAL ON YOUR BROWSER.

Changes

THE FOLLOWING ONLY APPLIES TO CALIFORNIA RESIDENTS:

The California Consumer Privacy Act (“CCPA”) provides consumers, who are California residents, with specific rights regarding their personal information. This Section describes your CCPA rights and explains how to exercise those rights.

ACCESS TO SPECIFIC INFORMATION

You have the right to request that Glastender disclose certain information to you about its collection and use of your personal information over the past 12 months. Once Glastender receives and confirms your verifiable consumer request, Glastender will disclose to you:

  • The categories of personal information Glastender collected about you.
  • The categories of sources for the personal information Glastender collected about you.
  • Glastender’s business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom Glastender shares that personal information.
  • The specific pieces of personal information Glastender collected about you.
  • If Glastender sold or disclosed your personal information for a business purpose via two separate lists disclosing:
    • Any sales of your personal information and identifying the personal information categories that each category of recipient purchased; and
    • Any disclosures for a business purpose and identifying the personal information categories that each category of recipient obtained.

DELETION REQUEST RIGHTS

You have the right to request that Glastender delete any of your personal information that it collected from you and retained, subject to certain exceptions. Once Glastender receives and confirms your verifiable consumer request, Glastender will delete (and, if applicable, direct our service providers to delete) your personal information from its records, unless an exception applies.

Glastender may deny your deletion request if retaining the information is necessary for Glastender or its service provider(s) to:

  • Complete the transaction for which Glastender collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of its ongoing business relationship with you, or otherwise perform its contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with Glastender.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

EXERCISING ACCESS AND DELETION RIGHTS

To exercise the access and deletion rights described above, please submit a verifiable consumer request to Glastender by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information.

You may only make a verifiable consumer request for access or deletion once within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows Glastender to reasonably verify you are the person about whom Glastender collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows Glastender to properly understand, evaluate, and respond to it.

Glastender cannot respond to your request or provide you with personal information if it cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with Glastender. However, Glastender does consider requests made through a password protected account sufficiently verified when the request relates to personal information associated with that specific account.

Glastender will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

RESPONSE TIMING AND FORMAT

Glastender endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If Glastender requires more time, it will inform you of the reason and extension period in writing.

If you have an account with Glastender, it will deliver its written response to that account. If you do not have an account with Glastender, it will deliver its written response by mail or electronically, at your option.

Any disclosures Glastender provides will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response Glastender provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, Glastender will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Glastender does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If Glastender determines that the request warrants a fee, Glastender will tell you why it made that decision and provide you with a cost estimate before completing your request.

You do not need to create an account with Glastender to exercise your opt-out rights. Glastender will only use personal information provided in an opt-out request to review and comply with the request.

NON-DISCRIMINATION

Glastender will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, Glastender will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, Glastender may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive Glastender offers will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

OTHER CALIFORNIA PRIVACY RIGHTS

California Civil Code Section § 1798.83 permits users of Glastender’s Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please write us at:
